Terms of Service

1. Agreement to Terms

By scheduling voice lessons, using our website (singwithmrdavis.com), or engaging Sing With Mr. Davis for vocal coaching services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

For students under 18 years of age, a parent or legal guardian must agree to these Terms on their behalf and is responsible for the student's compliance with these Terms.

2. Services Provided

Sing With Mr. Davis, a DBA of GM Associates LLC, provides voice lessons and vocal coaching services, including:

• Private voice lessons (in-person and online)
• Vocal technique instruction
• Performance coaching
• Repertoire development

2.1 Lesson Location

Lessons are conducted online via GoToMeeting or in-person at New Bethel Community Church, 175 Englewood Avenue, Buffalo, NY. Alternative arrangements may be made by mutual agreement.

4. Scheduling and Cancellation

4.1 Scheduling

Lessons are scheduled by mutual agreement. Regular weekly lesson times may be established for ongoing students.

4.2 Cancellation Policy

• Cancellations with 24 hours or more notice: No charge, lesson may be rescheduled
• Cancellations with less than 24 hours notice: Full lesson fee may apply
• No-shows: Full lesson fee applies
• Instructor cancellations: Lesson will be rescheduled at no charge
• Make-up lessons must be scheduled and completed within 60 days of the original lesson date or they are forfeited

4.3 Illness

If you are experiencing vocal illness or contagious symptoms, please cancel your lesson. We will work with you to reschedule without penalty when health concerns are involved.

5. Payment Terms

Payment is due at the time of the lesson unless other arrangements have been made.

• Accepted payment methods: Stripe, Venmo, CashApp, Apple Pay, Google Pay, Square
• Lesson packages, if purchased, are non-refundable and expire 12 months from the date of purchase
• Non-payment results in termination of the student-teacher relationship

6. Online Lessons

Online lessons are conducted via GoToMeeting. For online lessons:

• You are responsible for having a stable internet connection
• A quiet space with minimal background noise is recommended
• Technical difficulties on the student's end do not extend lesson time
• Lessons are not recorded without mutual consent

By using GoToMeeting for lessons, you also agree to their terms of service and privacy policy.

7. Intellectual Property

7.1 Lesson Materials

Any exercises, techniques, or materials shared during lessons are for your personal use only and may not be redistributed, published, or used for commercial purposes without permission.

7.2 Recordings

Lessons may not be recorded (audio or video) without prior consent from the instructor. Any approved recordings are for personal practice use only.

8. Expectations

8.1 Student Responsibilities

• Arrive on time and prepared for lessons
• Practice between lessons as recommended
• Communicate openly about goals and challenges
• Respect scheduling and cancellation policies

8.2 No Guaranteed Outcomes

Voice lessons provide instruction and guidance based on professional experience. Results vary based on individual practice, natural ability, and commitment. We do not guarantee specific outcomes, audition results, or career advancement.

8.3 Health and Vocal Wellness

Voice lessons are educational in nature and are not a substitute for medical advice. If you experience persistent vocal discomfort, hoarseness, or other symptoms, consult a medical professional. By participating in lessons, you acknowledge that you are physically able to engage in vocal exercises. We are not liable for any vocal strain or injury that may occur.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SING WITH MR. DAVIS (GM ASSOCIATES LLC) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF OUR SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC LESSON OR PACKAGE GIVING RISE TO THE CLAIM.

NOTHING IN THESE TERMS SHALL LIMIT LIABILITY FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR FRAUD.

10. Indemnification

You agree to indemnify and hold harmless Sing With Mr. Davis (GM Associates LLC) from any claims, damages, or expenses arising from your violation of these Terms, misuse of lesson materials, or infringement of any third-party rights.

11. Termination

Either party may end the student-teacher relationship at any time:

• Students may discontinue lessons with notice
• Prepaid lesson packages remain valid but are non-refundable
• We reserve the right to decline continued services if policies are repeatedly violated

12. Dispute Resolution

Any disputes will first be addressed through direct communication at singbetter@proton.me. These Terms are governed by the laws of the State of New York, and any legal proceedings shall take place in Erie County, New York.

13. Force Majeure

Neither party shall be liable for failure to perform due to circumstances beyond reasonable control, including natural disasters, illness, or other emergencies. Affected lessons will be rescheduled.

14. Changes to Terms

We may update these Terms periodically. Continued use of our services after changes constitutes acceptance of the updated Terms.

15. General Provisions

• Entire Agreement: These Terms and our Privacy Policy constitute the complete agreement
• Severability: If any provision is unenforceable, the remaining provisions remain in effect
• Waiver: Our failure to enforce any right does not waive that right
• Electronic Communications: You consent to receive email communications regarding scheduling and lessons

By scheduling lessons with Sing With Mr. Davis, you acknowledge that you have read, understood, and agree to these Terms of Service.
